Sobre la aplicación de la teoría del dominio de la voluntad en virtud de aparatos organizados: análisis a la luz del estallido social en Chile

    Según las últimas cifras entregadas por el Instituto Nacional de Derechos Humanos, existe actualmente un total de 2.873 procesos iniciados en virtud de los hechos ocurridos en el marco del denominado estallido social en los que el Ministerio Público aún no ha comunicado la existencia de personas imputadas. Esta realidad vuelve necesaria la reconsideración de figuras legales que permitan imputar responsabilidad penal a aquellos individuos que, sin haber ejecutado directamente los delitos cometidos por miembros de Carabineros de Chile, tienen la dirección y supervisión de dichas organizaciones. Por ello, este trabajo aborda la posibilidad de aplicar la teoría del do-minio de la voluntad en virtud de aparatos organizados de poder, proponiendo para ello una propuesta de interpretación del elemento de apartamiento del derecho exigido por Roxin para dar lugar a esta figura, y así verificar finalmente si es posible sostener su aplicación en el marco del denominado estallido social.

    According to the latest figures provided by the Human Rights Institute, there are currently a total of 2,873 proceedings initiated as a result of the events that occurred within the framework of the so-called social outburst, in which the Public Prosecutor’s Office has not yet been informed of the existence of persons charged. This reality makes it necessary to reconsider legal figures that allow criminal responsibility to be imputed to those individuals who, without having directly executed the crimes com-mitted by members of the Carabineros de Chile, have the direction and supervision of such organizations. Therefore, this paper addresses the possibility of applying the theory of dominion of will by virtue of organized apparatuses of power, proposing an inter-pretation of the element of deviation from the law required by Roxin to give rise to this figure, to finally verify whether it is possible to sustain its application in the framework of the so-called social outburst.
