    Partiendo del concepto de identidad constitucional que es empleado por las jurisdicciones constitucionales de los Estados miembros de la Unión Europea y por el Tribunal de Justicia de la Unión, este trabajo estudia si en el contexto del Consejo de Europa se invoca también o si el reconocimiento del margen de apreciación nacional de los Estados por parte del TEDH cumple la función de principio integrador que el principio del respeto a la identidad nacional tiene en la Unión Europea.

    Starting from the concept of constitutional identity that is used by the constitutional jurisdictions of the Member States of the European Union and by the EU Court of Justice, this paper studies whether in the context of the Council of Europe is also invoked or if the recognition of the national discretion of the States by the ECtHR fulfills the function of integrating that the principle of respect for national identity has in the European Union.
