Resumen de Smart Contracts y Activos Digitales a la Luz del Derecho Sucesorio Ecuatoriano

  Las tecnologías modernas facilitan aspectos de la vida humana, enriqueciéndose con oportunidades de nuevas formas de comunicación, de aprendizaje y conocimiento, que permiten la realización de diversas actividades de manera mucho más barata, rápida y eficaz. El mundo del derecho no es ajeno a esta nueva revolución. El grado de desarrollo moderno de mano de la tecnología, la era de la digitalización y la globalización en general, también ha ampliado el espectro de las relaciones humanas como lo dirían Omelchuck y Iliopol (2021), los cuales reconocen que las relaciones que surgen en torno al nuevo espacio digital. El uso y disposición de dichos bienes inmateriales después del fallecimiento de su titular es un factor que determina la necesidad de regular dichas relaciones en el plano del derecho, en este caso, específicamente en el ámbito sucesorio. Actualmente estamos acostumbrados a escuchar a nuestro alrededor términos como smart contracts, activos digitales y blockchain, aspectos que se ven necesariamente inmiscuidos en la vida diaria de las personas a tal grado que el derecho necesita adaptarse a estos nuevos cambios para generar regulaciones conscientes y adecuadas. La eficacia de la regulación jurídica surge de una determinada base sólida-científica que permite identificar los aspectos básicos de estas herramientas tecnológicas que se adaptarán a actos normativos adecuadamente regulados. Ampliar la gama de derechos protegidos (objetos tangibles e intangibles), y buscar las herramientas o instrumentos más idóneos para garantizar su protección y ejercicio (smart contracts a través de redes blockchain), es un trabajo que nace desde el desarrollo teórico de los mismos, por ello, será indispensable primero conocer y tener claro la definición y naturaleza de estos conceptos, los que se abordan en el trabajo siguiente.PALABRAS CLAVE: smart contracts; activos digitales; blockchain,

The legal world is no stranger to this new revolution. The use and disposition of said intangible assets after the death of their owner is a factor that determines the need to regulate said relationships in the field of law, in this case, specifically in the field of succession. We are currently used to hearing around us terms such as smart contracts, digital assets and blockchain, aspects that are necessarily intruded into people's daily lives to such a degree that the law needs to adapt to these new changes to generate conscious and adequate regulations. The effectiveness of legal regulation arises from a certain solid-scientific base that allows the identification of the basic aspects of these technological tools that will be adapted to adequately regulated normative acts. Expanding the range of protected rights (tangible and intangible objects), and looking for the most suitable tools or instruments to guarantee their protection and exercise (smart contracts through blockchain networks), is a work that is born from the theoretical development of the same, For this reason, it will be essential to first know and be clear about the definition and nature of these concepts, which are addressed in the following work.KEYWORDS: smart contracts; digital assets; blockchain.
