Históricamente, la excesiva intervención corporal/espiritual del Estado absolutista intervenía sobre el cuerpo, castigándolo, y de la Iglesia que lo hacía sobre las almas para preservarlas. Dicho Estado medieval y de tipo monárquico, religioso y confesional, presenta a Dios y a la espada como dos elementos que van de la mano y son una expresión de su violencia. La garantía de no autoincriminación nace en los tiempos del iluminismo como respuesta a la intervención, más que excesiva y carente de toda limitación y parámetro por sobre la vida, del estado absolutista junto con la iglesia católica. El cuerpo, como objeto de tormento, deja de ser viable y tolerable, pues ahora el acusado pasa a ser también un sujeto de derechos

Historically, the excessive corporal/spiritual intervention of the absolutist State intervened on the body, punishing it, and of the Church, which intervened on souls to preserve them. This medieval, monarchical, religious and confessional State presents God and the sword as two elements that go hand in hand and are an expression of its violence. The guarantee of non-self-incrimination was born in the times of enlightenment as a response to the intervention, more than excessive and lacking in any limitation and parameter over life, of the absolutist state together with the Catholic Church. The body, as an object of torment, ceased to be viable and tolerable, since now the accused also became a subject of rights.
