    El Estatuto de Roma atribuye a la Corte Penal Internacional el enjuiciamiento de los delitos más graves con trascendencia para la comunidad internacional. Tal jurisdicción tiene carácter complementario respecto de las jurisdiccionales nacionales penales. El Estatuto tan sólo reconoce legitimación para ser parte al Fiscal y al acusado. Por tanto, no es parte en este proceso la víctima del hecho delictivo. No obstante, la regulación prevista en el Estatuto y Reglamentos prevé la posibilidad de que las víctimas intervengan en las diferentes fases del proceso a través de distintas formas de participación.

    The Rome Statute attributes to the International Criminal Court the prosecution of the most serious crimes with transcendence for the international community. Such jurisdiction is complementary to the national criminal jurisdictions. The Statute only recognizes legitimacy to be a party to the Prosecutor and the accused. Therefore, the victim of the criminal act is not a party to this process. However, the regulation provided for in the Statute and Regulation provides the possibility for victims to intervene in the different phases of the process through different forms of participation.
