Resumen de La primacía del supérstite en la sucesión legal en Inglaterra: comparativa con la regulación del Código civil y el Derecho civil vasco

  Los profundos cambios experimentados por la institución familiar en las últimas décadas sitúan al cónyuge o pareja estable en el centro de los nuevos modelos familiares, haciendo necesario que nos replanteemos si la protección sucesoria que recibe refleja la posición destacada que ocupa en la familia y en los afectos del causante. En el caso inglés, la respuesta debe ser afirmativa, ya que, en sede de sucesión legal, el cónyuge o pareja recibe un trato tan favorable, que, a menudo, los hijos y descendientes del causante quedan excluidos de su sucesión. Este modelo contrasta con la cobertura sucesoria contemplada para el supérstite en el Derecho civil vasco y, más aún, en el sistema del Código civil. La distancia entre las propuestas de cada ordenamiento refleja la dificultad de encontrar una solución equilibrada que dé respuesta a la situación del supérstite sin desatender a los descendientes vulnerables.

  The changes experienced in recent decades by the family as an institution have placed the spouse or partner at the centre of the new emerging family structures, which makes it necessary to question if the protection afforded to the surviving spouse or partner under succession law, reflects her or his position in the family of the deceased. It certainly does under English law, where the surviving spouse or partner is treated so favourably that, often, the children of the deceased do not receive any part of their parent’s inheritance. This approach differs from that envisaged under Basque law and, more so, under the succession system of the Spanish Civil Code. The distance between the different legal schemes reflect the difficulty to strike an appropriate balance in the distribution of the estate between the surviving spouse or partner and the issue of the deceased.
