El Pleno del Tribunal Supremo en su Sentencia n.o 617/22 de 22 de junio, resuelve recurso de interés casacional, sobre si el juicio celebrado en ausencia garantiza constitucionalmente la efectividad de la audiencia del penado, previa a la expulsión de España, conforme al artículo 89 del Código Penal; y concluye que si la decisión de expulsión se adopta en el juicio celebrado en ausencia, no hay motivo legal para derivar la decisión sobre la expulsión, a la fase de ejecución, siempre que se hayan satisfecho todas las condiciones de audiencia exigidas por la norma.
The Plenary of the Supreme Court in its Judgment n.o 617/22 of June 22, resolves an appeal of cassation interest, on whether the trial held in absentia constitutionally guarantees the effectiveness of the hearing of the prisoner, prior to the expulsion from Spain, in accordance with article 89 of the Penal Code; and concludes that if the expulsion decision is adopted in the trial held in absentia, there is no legal reason to refer the decision on the expulsion to the execution phase, provided that all the hearing conditions required by the norm have been met.
