El interrogante acerca de si el sucesor continúa la persona del causante o simplemente losucede en sus bienes ha generado una larga controversia en la doctrina, desarrollándose dos corrientes conel propósito de fundamentar el origen de la herencia romana. Por una parte, la idea de una ficción quehacía sobrevivir la personalidad del causante, que expresada o a través de sus parientes próximoscontinuaba rigiendo el destino de sus bienes. Otro criterio se sustentaba en que tenía como finalidad lacontinuidad del culto familiar y el ejercicio de las potestades del paterfamilias, pero no la sucesión en losbienes, porque ellos estaban destinados al sustento del grupo familiar. La primera regulación en materia sucesoria aparece en el sistema del derecho quiritario que giraba en torno de la voluntad absoluta del pater, no existiendo restricción alguna a ese poder soberano. Surgieron dos interpretaciones, que serán objeto de análisis, acerca del ejercicio de la libertad testamentaria. El trabajo analiza la evolución de la libertad testamentaria en las fuentes romanas desde el derecho primitivo, su evolución en la República, su presencia en el Corpus Iuris Civilis y la suerte que tuvo su proyección al Código Civil y Comercial de 2015.
The question about whether the successor continues the person of the deceased or simplysucceeds him in his assets has generated a long controversy in the doctrine, developing two currents withthe purpose of substantiating the origin of the Roman inheritance. On the one hand, the idea of a fictionthat made the personality of the deceased survive which expressed or through his close relatives,continued to govern the fate of his assets. Another criterion was based on the fact that it had as its purposethe continuity of family worship and the exercise of the powers of the paterfamilias, but not thesuccession of asset, because they were intended to support the family group.The first regulation insuccession matters appears in the quiritary law system that revolved around the absolute will of the pater,with no restrictions whatsoever on that sovereign power. Two interpretations emerged, which will beanalyzed, about the exercise of testamentary freedom.The work analyzes the evolution of testamentaryfreedom in Roman soruces from primitive law its evolution in the Republic, its presence in the CorpusIuris Civilis and the fate of its projection to the Civil and Commercial Code of 2015
