La responsabilidad penal para adolescentes: un sistema entre la zanahoria y el garrote

    El trabajo en cuestión analiza la tensión entre las finalidades retributiva y de prevención general, junto con la finalidad educativa en el Sistema de Responsabilidad Penal para Adolescentes. Esto, en el marco de la sustitución y modificación de la sanción privativa de la libertad en primera instancia en la ciudad en Bogotá. Inicialmente, se brinda un contexto general de la doctrina y la jurisprudencia en esta materia, para posteriormente contrastarlo con las prácticas encontradas en primera instancia. Para ello se practicaron entrevistas semiestructuradas a los ocho jueces de conocimiento de la jurisdicción. Se encontró que la práctica en primera instancia dista de la doctrina y la jurisprudencia de las Altas Cortes, lo cual cuestiona el sistema como uno diferenciado del de los adultos.

    The following paper analyzes the existing tensions between the re-tributive and general prevention purposes of the Youth Criminal System, and its educational intend. This, in the context of the substitution and modification of the first instance incarceration decision in Bogotá, Colombia. The text will provide an overview of the doctrine and jurisprudence on the matter and contrast it with the judicial practices found on the first instance courts. The knowledge on these judicial practices was gathered by conducting eight semi-structured interviews to judges that are firsthand experts on the matter. In conclusion, it was found that first instance practices differ from the findings in the doctrine and jurisprudence of the high courts, which questions the system as a differentiated system from the one established for adults.
