Resumen de Eficacia de la mediación familiar en Cataluña

  El objetivo del estudio ha sido evaluar la eficacia de la mediación familiar en Cataluña mediante tres criterios: tipo de finalización del proceso, grado de mantenimiento de los acuerdos y posible retorno al Sistema Judicial. Tras analizarse los expedientes judiciales relativos a los procesos de mediación finalizados durante el año 2008 se administró una entrevista elaborada “ad hoc” sobre 232 participantes. Los voluntarios respondieron a las cuestiones relativas al mantenimiento de los acuerdos y retorno al Sistema Judicial. Los resultados mostraron diferencias significativas respecto al retorno, así los participantes firmantes de acuerdos regresaron al sistema en menor grado que los no firmantes. Así mismo, los sujetos capaces de mantener los acuerdos también regresaron menos respecto a los que no los habían mantenido. El periodo de regreso al Sistema Judicial tras finalizarse la mediación familiar se produjo dentro del primer año posterior o a lo sumo, al año siguiente. Los motivos del retorno fueron los mismos por los cuales habían acudido a la mediación la primera vez. En conclusión, existe un cierto grado de eficacia en el proceso de la mediación. Sin embargo, debemos tener en cuenta que el riesgo para un posible retorno al sistema es mayor durante el primer año tras la finalización del proceso de mediación, sobre todo en aquellos sujetos que no encontraron una solución idónea a los conflictos por los cuales acudieron.

  The aim of this study was to evaluate the effectiveness of family mediation in Cataluña by using three measures: the outcome of the process (agreement or lack of agreement), the compliance with the agreements and the return to the Judicial System. The files of all the processes that finalized in 2008 were analyzed. Moreover, a previously designed “ad hoc” interview was used among the parts mediated during that period. A total of 232 volunteers answered questions related to the compliance with the agreements and the return to the Judicial System. The results showed significant differences as to the return rates. This rate was smaller among participants who finalized mediation with agreements in comparison with those subjects who didn’t sign any agreement. Furthermore, the subjects that experience in agreements also showed smaller return rate than those who weren’t compliant with the settlements. The return to the system generally took place within first or second year after the mediation finalized. The motives of the comeback were the same that drove subjects to the first use of alternative conflict resolution program. According to those results, family mediation shows certain effectiveness. Nevertheless, the major risk for the return is within the first year after the process finalizes, especially when the participants didn’t find answer to their conflicts.
