Se realiza un recuento del tratamiento que tuvo y tiene en Colombia el porte y consumo de sustancias estupefacientes, desde el punto de vista legal, como el proceder de las autoridades judiciales frente a esta problemática. La rama judicial colombiana ha transitado por senderos donde los pilares de la teoría del delito han sido flexibilizados, e incluso ignorados, en detrimento de las garantías fundamentales de un Estado de derecho. Se destacan las maneras, bien intencionadas, pero ilegítimas, mediante las cuales la Corte Suprema de Justicia decide declarar impune el comportamiento carente de potencialidad lesiva.
A recount is made of the treatment that the possession and consumption of a narcotic substance had and has in Colombia, from the legal point of view, as well as the procedure of the judicial authorities to the face this problem. Where the Colombian judicial branch has traveled through paths where the pillars of the Theory of Crime have been both flexible, and even ignored, to the detriment of the fundamental guarantees of a Theory of Crime. The wellintentioned but illegitimate ways in which the Supreme Court of Justice decides to declare unpunished behavior devoid of harmful potentiality are highlighted.
