    La falta de regulación en nuestra LECrim del partícipe a título lucrativo a quien se le exigirá en el marco de un proceso penal una responsabilidad civil basada en el enriquecimiento injusto, y distinta a la responsabilidad civil «ex delicto» exigible al autor del hecho del que deriva su propia responsabilidad civil, hace necesario establecer cuáles son las líneas básicas de dicha figura y su incidencia en el proceso penal.
