    El estudio de la legislación de los territorios romano germánicos es fundamental para entender el fenómeno de la recepción del Derecho Romano en Europa. Este estudio trata de exponer la importancia que puede tener el estudio del Edicto de Teodorico para comprender la evolución del Derecho Romano y el alcance de su aplicación en la práctica de la Italia ostrogoda del s. VI. El legislador toma aquello que le interesa del Derecho Romano y lo adapta a la nueva realidad consecuencia de la llegada de la población ostrogoda. Para asegurar el cumplimiento de esta legislación es esencial la figura del juez, por ello, a pesar de que se trata de un cuerpo legal de poca extensión, a esta cuestión se dedican un número importante de fragmentos. En ellos se regulan cuestiones relativas a la actuación del juez en el inicio del procedimiento, en la fase probatoria, el momento de dictar sentencia, la apelación de ésta, así como la sanción al juez que actúa de forma indebida incumpliendo sus obligaciones.

    The study of the legislation of the Germanic Roman territories is fundamental to understanding the phenomenon of the reception of Roman Law in Europe. This study tries to expose the importance that the study of the Edict of Theodoric can have to understand the evolution of Roman Law and the scope of its application in the practice of Ostrogothic Italy of the sixth century. The legislator takes what interests him from Roman law and adapts it to the new reality resulting from the arrival of the Ostrogothic population. To ensure compliance with this legislation, the figure of the judge is essential, therefore, despite the fact that it is a legal body of little extension, a significant number of fragments are dedicated to this issue. They regulate issues related to the action of the judge at the beginning of the procedure, in the evidentiary phase, the moment of issuing the sentence, the appeal of this as well as the sanction to the judge who acts improperly in breach of his obligations.
