  El presente trabajo se propone ofrecer una serie de anotaciones críticas en torno a las doctrinas existentes sobre la prescripción extintiva. Partiendo de su origen en el Derecho romano y su recepción en el ius commune europeo y en las codificaciones contemporáneas, se discuten las diversas teorías en torno a esta prescripción en la doctrina moderna y diversos problemas en torno a la naturaleza y efectos de esta figura.

  This article is aimed to propose some critical remarks on the existing theories about extinctive prescription. Departing from its origins in Roman law and its reception in the European ius commune and the contemporary codifications, several modern theories about this prescription and some problems around the legal nature and effects of this institution are here discussed.
