El trabajo analiza la problemática derivada de la extinción de concesiones de aprovechamientos hidroeléctricos, explorando y valorando las distintas alternativas legales para la explotación de las instalaciones una vez éstas han revertido al Estado. Tras señalar algunas oportunidades de reforma normativa para mejorar el tratamiento de las centrales revertidas, se recomienda la opción por soluciones colaborativas público-privadas a largo plazo pero con una revisión del modelo retributivo que sea acorde con el sistema vigente de precios de la energía, en aras del interés general.

This paper analyses the problems issuing from the termination of hydroelectric concessions, exploring and assessing the alternatives offered by the Law for the operation of the hydroelectric power plants reverted to the State. After pointing out some opportunities for regulatory amendment to improve the legal treatment of reverted hydroelectric power plants, it advocates for long-term public-private agreements, suggesting a review of the remuneration model consistent with the current energy price system, for the sake of the public interest.
