    La homologación judicial de los planes de reestructuración conlleva el efecto de “proteger la financiación interina y la nueva financiación que prevea el plan, así como los actos, operaciones o negocios realizados en el contexto de éste frente a acciones rescisorias”, en caso de frustración del plan y apertura del concurso de acreedores. El grado de protección varía en función de si los acreedores afectados por el plan homologado representan al menos el 51% del pasivo total o no.

    Judicial homologated of restructuring plans has the effect of “protecting the interim financing and the new financing provided for in the plan, as well as the acts, operations or businesses carried out in the context thereof against rescission actions”, in the event of frustration of the plan and opening of bankruptcy proceedings. The degree of protection varies depending on whether the creditors affected by the approved plan represent at least 51% of the total liabilities or not.
