Resumen de Motivos jurídicos y sociales de las no denuncias penales por actos de discriminación racial o racismo en población afrodescendiente en Medellín

  La Ley 1482 de 2011 conocida también como Ley Antidiscriminación define el tipo penal de la discriminación racial, sin embargo, en Medellín, ciudad que cuenta con 236 000 personas de población afrodescendiente y en la que se ha denunciado socialmente actos de discriminación hacia esta población, no se tiene un número significativo de denuncias penales, ya que solo se han efectuado doce por actos de discriminación o racismo. La pregunta que motivó la investigación fue: ¿cuáles son los motivos jurídicos y sociales por los que personas afrodescendientes que afirman haber experimentado situaciones de discriminación racial o racismo no hacen denuncias penales? Para responder dicho cuestionamiento se realizó una investigación cualitativa que, a través de entrevistas en profundidad a personas que afirman haber experimentado situaciones de discriminación racial o racismo, permitió conocer los diferentes motivos jurídicos y sociales por las que estas no hacen denuncias penales.

  The Law 1482 of 2011, also recognized as the "Anti-Discrimination Law" is intended to "guarantee the protection of the rights of a person, group of people, community or people, which are violated through acts of racism or discrimination" and defines Article 134 A "he who arbitrarily prevents, obstructs or restricts the full exercise of the rights of persons because of their race, nationality, sex or sexual orientation, shall incur imprisonment from twelve (12) to thirty-six (36) months and a fine of ten (10) to fifteen (15) current monthly legal minimum wages. " However, in Medellín, a city that has 236,000 people of Afro-descendant population and in which acts of discrimination against this population have been socially denounced, there is no significant number of criminal complaints since only twelve have been made for acts of discrimination and racism The question that motivated the investigation was: What are the legal and social reasons why people of African descent who claim to have experienced situations of racial discrimination and racism do not make criminal complaints? To answer this question, a qualitative investigation was carried out that, through in-depth interviews of people who claim to have experienced situations of racial discrimination and racism, allowed us to know the different legal and social reasons why they do not make criminal complaints.
