Resumen de La reducción en el consumo de bolsas de plástico como elemento clave de un modelo de economía circular: un análisis desde el Derecho

Las conductas humanas consumistas, la cultura del derroche y el modelo económico lineal –arraigado des del origen de la Primera Revolución Industrial en nuestras sociedades– han devenido factores determinantes para la aparición de la crisis climática que amenaza el medio ambiente. Las consecuencias fatídicas que ya están perjudicando la vida terrestre, han hecho surgir una conciencia ambiental reaccionaria tanto desde la vertiente económica –de la que emana un modelo económico circular– como de la social. La sensibilización aun no es absoluta y es por ello que resulta esencial la intervención legislativa para combatir estas conductas y también para resolver y paliar los efectos que la actuación humana e industrial han ocasionado en el medio ambiente. Este estudio, se centra específicamente sobre el análisis jurídico del impacto que han tenido las bolsas de plástico en los sistemas acuáticos y terrestres y las medidas que aplican los organismos comunitarios –europeos– y los españoles para resolver las afectaciones pasadas y reducir las futuras. Con esta finalidad, después de realizar un análisis general de la economía circular como eje motivador de la adopción de medidas contra el plástico, se examinan en profundidad la Directiva (UE) 2015/720 y su transposición en el ordenamiento jurídico español mediante el Real Decreto 293/2018.

Human consumer behaviours, the culture of waste and the linear economic model – rooted since the origin of the First Industrial Revolution in our societies – have become determining factors for the emergence of the climate crisis which threatens the environment. The fateful consequences that are already damaging terrestrial life have given rise to a reactionary environmental awareness both from the economic perspective – from which a circular economic model emanates – and from the social one. Awareness is not yet absolute and that is why legislative intervention is essential not only to combat these behaviours but also to resolve and mitigate the effects that human and industrial action have caused on the environment. This study focuses specifically on the legal analysis of the impact that plastic bags have had on aquatic and terrestrial systems and the measures applied by the European Union organizations and Spanish organizations to resolve past effects and reduce future ones. With this aim, after carrying out a general analysis of the circular economy as the motivating axis for the adoption of measures against plastic, Directive (EU) 2015/720 and its transposition into the Spanish legal system are thoroughly examined by means of the Royal Decree 293/2018.
