Resumen de O mal, o crime e a pena: a fundamentação moral da pena sob uma perspectiva histórica e filosófica.

  O presente trabalho, que encontra-se localizados dentro das ciências penais e da filosofia do direito, tem por escopo estudar a fundamentação moral da pena, assim como os problemas relacionados as questões punitivas, buscando compreender onde a humanidade encontra a autorização moral para punir. Assim, em um primeiro momento foram feitas algumas diferenciações e observações pertinentes a pena propriamente dita, distinguindo punição estatal e punição interpessoal, e tratando da dualidade justiça versus punição. Posteriormente, buscando responder a pergunta “por que punir?”, foram analisadas as questões que ligam culpa, pecado, crime e punição, cujas raizes estão na origem do mal, que foi compreendido de diferentes formas ao longo da história. Nesse tocante, foi imprescindível analisar o mal na mitologia até a interpretação do mal como falha humana, sua relação com o pecado e com sua consequente punição divina em que se basearam as noções de crime e de punição estatal. Foram utilizados o método de abordagem dialético, método de procedimento histórico e comparativo, e o método de interpretação sociológico. Já a pesquisa, quanto a sua natureza, foi qualitativa teórica, e quanto aos objetivos é uma pesquisa descritiva e explicativa, utilizando-se do procedimento bibliográfico.

  The present work, which is located within the criminal sciences and philosophy of law, aims to study the moral foundation of punishment, as well as the problems related to punitive issues, seeking to understand where humanity finds the moral authorization to punish. Thus, at first, we sought to make some distinctions and observations relevant to the penalty itself, distinguishing state punishment and interpersonal punishment, and dealing with the duality of justice versus punishment. Subsequently, seeking to answer the question “why punish?”, the questions that link guilt, sin, crime, and punishment were analyzed, whose roots are in the origin of evil, which has been understood in different ways throughout history. In this regard, it was essential to analyze evil in mythology until the interpretation of evil as a human failure, its relationship with sin, and its consequent divine punishment on which the notions of crime and state punishment were based. The dialectical approach, historical and comparative procedure and sociological interpretation methods were used. The research, in terms of its nature, was qualitative and theoretical, and in terms of objectives, it is descriptive and explanatory research, using the bibliographic procedure.
