Resumen de Parejas de hecho y animales de compañía tras la Ley 17/2021, de 15 de diciembre

La Ley 17/2021, de 15 de diciembre, de modificación del Código Civil, la Ley Hipotecaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales, sigue la senda instaurada por el TFUE y otros ordenamientos jurídicos próximos, y reconoce a los animales su cualidad de seres sensibles. En el presente trabajo se pretenden analizar las principales novedades introducidas por dicho texto normativo en relación a los animales de compañía y el Derecho de Familia, abordando cuestiones como el olvido por parte del legislador de las parejas de hecho o si debería considerarse a los animales como cargas del matrimonio, entre otros interrogantes.

Law 17/2021, of December 15, modifying the Civil Code, the Mortgage Law and the Law of Civil Procedure, on the legal regime of animals, follows the path established by TFUE and other nearby legal systems, and recognizes animals their quality of sentient beings. In the present work we intend to analyze the main novelties introduced by said normative text in relation to companion animals and Family Law, addressing issues as the forgetfulness by the legislator of unmarried couples or if they should be considered as burdens of marriage, among other questions.
