En contextos de crisis crece el interés por la doctrina rebus. Y aumenta la presión para que deje de ser un recurso jurídico excepcional: se busca que sea, con carácter general, argumento justificativo para la modulación o ruptura del vínculo contractual, cuando nuevos contextos (ni tan imprevisibles ni tan extraordinarios) afecten a la economía del deudor, sin tratarse de supuestos de exoneración. Los riesgos inherentes al contrato pretenden ser deslocalizados, externalizados. Y la estrategia se cuela, también, en el ámbito del cumplimiento de las obligaciones intrafamiliares.
In contexts of crisis, interest in the rebus doctrine grows. And the pressure is increasing so that it ceases to be an exceptional legal resource: it is intended to be, in general, a justifying argument for the modulation or rupture of the contractual relationship, when new contexts (neither so unpredictable nor so extraordinary) affect the economy of the debtor, without dealing with assumptions of exoneration. The risks inherent in the contract are intended to be relocated, externalized. And, the strategy sneaks in, too, in the field of fulfilling intra-family obligations.
