  Neste artigo, buscamos oferecer um panorama dos debates sobre o futuro da jurisdição constitucional, analisando criticamente as principais posições e tomando partido na sua disputa. Para atingir esse objetivo, procedemos da seguinte maneira: 1) diagnosticamos alguns dos problemas jurídicos relacionados às disfuncionalidades nos países democráticos; 2) identificamos as mudanças institucionais defendidas nesse período; e 3) discutimos como seria a jurisdição constitucional adequada aos problemas que diagnosticamos, correlacionando esse debate sobre novos arranjos institucionais ao estado da arte sobre teorias da interpretação.

  In this article, we seek to provide an overview of debates on the future of judicial review, analyzing critically the main positions and taking sides in their dispute. To achieve this objective, we proceeded as follows: 1) we diagnosed some of the legal problems related to dysfunctions in democratic countries; 2) we identified the institutional changes advocated in this period; and 3) we discuss how the judicial review would be adequate to the problems we diagnose, correlating this debate on new institutional arrangements to the state of the art on theories of interpretation.
