Resumen de El papel de la inspección educativa sobre los estudios superiores de música como educación superior no universitaria

En el presente estudio se analizan los estudios superiores de música como parte de las Enseñanzas artísticas superiores que conforman la educación superior no universitaria. En el contexto de nuestro sistema educativo, con una tradicional división binaria entre enseñanza universitaria y no universitaria, la definición de un régimen jurídico híbrido para estos estudios genera disfunciones que requieren de mejoras regulatorias en su definición, el profesorado y loscentros docentes en que se imparten. Identificados estos fallos regulatorios, el objeto del trabajo es señalar en qué medida los servicios de inspección educativa desarrollan las funciones de control de legalidad y garantía de la calidad educativa que le son propias, dejando claro desde el principio que el grado de autonomía reconocido a los Conservatorios Superiores de música no elude su sometimiento a la tutela de la Administración educativa. La metodología del estudio es la propia de las ciencias jurídicas, que combina las fuentes normativas con las posiciones doctrinales y jurisprudenciales de aplicación. La autora sostiene una dilatada línea de investigación sobre el régimen jurídico de las enseñanzas musicales desde un enfoque de Derecho administrativo.

In the present study, higher music studies are analyzed as part of higher artistic education that make up non-university higher education. In the context of our educational system, with a traditional binary division between university and non-university education, the definition of a hybrid legal regime for these studies generates dysfunctions that require regulatory improvements in the definition of these studies, their teaching staff and the centers in question. that are taught Having identified these regulatory failures, the purpose of the work is to point out to what extent the educational inspection services carry out the functions of legality control and guarantee of educational quality that are their own, making it clear from the beginning that the degree of autonomy recognized to the Higher Music Conservatories do not evade their submission to the tutelage of the Educational Administration. The methodology of the study is that of the legal sciences, which combines the normative sources with the doctrinal and jurisprudential positions of application. The author maintains a long line of research on the legal regime of musical education from an administrative law approach.
