Resumen de El volcán de La Palma: medidas jurídicas para la garantía de los derechos de los afectados

  El 19 de septiembre de 2021 comenzó la erupción de un volcán en la zona de Cumbre Vieja en la isla de La Palma, que finalizó el día 13 de diciembre del mismo año. Durante 86 días, los ciudadanos afectados han sufrido la pérdida de sus propiedades, tales como su vivienda habitual, casas rurales, establecimientos profesionales, mercantiles e industriales, así como sus fincas agrícolas y ganaderas.

  En el presente trabajo explicamos, desde el punto de vista del derecho administrativo, la labor desempeñada por las Administraciones públicas en tres etapas y su repercusión sobre los afectados:

  1. El prevolcán: Los ciudadanos afectados no fueron informados previamente de los diferentes estudios científicos del fenómeno preeruptivo, que comenzó en 2017.

  2. El volcán: La coordinación entre todos los servicios de seguridad y emergencias de las Administraciones públicas para evitar muertos y lesionados, así como del consenso administrativo de todas las ayudas paliativas aprobadas.

  3. El posvolcán: La necesaria regulación por leyes estatales y canarias de los derechos de los afectados mediante la creación de un estatuto jurídico ad hoc.

  On September 19, 2021, the eruption of a volcano began in the Cumbre Vieja area on the island of La Palma, which ended on December 13 of the same year. For 86 days, the affected citizens have suffered the loss of their properties such as their habitual residence, rural houses, professional, commercial and industrial establishments, as well as their agricultural and livestock farms.

  In this paper we explain from the point of view of Administrative Law the work carried out by public Administrations in three stages and its impact on those affected:

  1. The prevolcano: The affected citizens were not previously informed of the different scientific studies of the preeruptive phenomenon that began in 2017.

  2. The volcano: The coordination between all the security and emergency services of the public Administrations to avoid deaths and injuries, as well as the administrative consensus of all the approved palliative aid.

  3. The posvolcano: The necessary regulation by state and Canary Islands laws of the rights of those affected through the creation of an ad hoc legal statute.
