Resumen de El robot como producto defectuoso y responsabilidad civil

En el presente estudio se reflexiona sobre la responsabilidad civil extracontractual por daños causados por un robot. De la personalidad electrónica que se indicaba en la Resolución del Parlamento Europeo, de 16 de febrero de 2017 hasta las recientes Propuestas de Reglamento y Directivas sobre responsabilidad civil en materia de inteligencia artificial y por productos defectuosos son numerosas las cuestiones que se suscitan en torno a cómo articular la responsabilidad en la que interviene la inteligencia artificial. El dilema entre responsabilidad objetiva o subjetiva o por culpa es motivo de discusión, y las propuestas legislativas se inclinan por la responsabilidad subjetiva teniendo en cuenta las dificultades de prueba. Ahondaremos en estos aspectos, centrándonos en el robot como un producto defectuoso y la injerencia de la responsabilidad derivada de un producto en el que se contempla la intervención humana. Con ello, obtendremos unas conclusiones para la comprensión de la futura legislación

In this study, we reflect on extracontractual civil liability for damages caused by a robot. From the electronic personality that was indicated in the Resolution of the European Parliament, of February 16, 2017, to the recent Proposals for Regulations and Directives on civil liability in the field of artificial intelligence and for defective products, there are numerous questions that arise around how to articulate the responsibility in which artificial intelligence intervenes. The dilemma between objective or subjective liability or due to fault is a matter of discussion, and the legislative proposals are inclined towards subjective liability, taking into account the difficulties of proof. We will delve into these aspects, focusing on the robot as a defective product and the interference of the responsibility derived from a product in which human intervention is contemplated. With this, we will obtain some conclusions for the understanding of the future legislation.
