La elaboración de un Código de Conducta para árbitros y jueces ha sido uno de los temas prioritarios del Grupo de Trabajo III de la Comisión de las Naciones Unidas para el Derecho Mercantil Internacional (CNUDMI), que tiene por mandato reformar el sistema de solución de controversias entre inversionistas y Estados (SCIE). El presente artículo describe brevemente los antecedentes que dieron lugar a la elaboración del Código de Conducta y del Comentario y ofrece una visión general de su contenido y de los avances en su proceso de elaboración, incluyendo las últimas aclaraciones y observaciones más relevantes de las Secretarías de la CNUDMI y del CIADI, así como de los Estados y otras partes interesadas.
The elaboration of a Code of Conduct for arbitrators and judges has been one of the priority topics of Working Group III of the United Nations Commission on International Trade Law (UNCITRAL), which is mandated to reform the investor‐state dispute settlement (ISDS) system. This article briefly describes the background that led to the elaboration of the Code of Conduct and the Commentary and provides an overview of its contents and the progress in its elaboration process, including the latest clarifications and most relevant comments from the UNCITRAL and ICSID Secretariats, as well as from States and other interested parties.
