Al hilo de una Sentencia dictada en apelación por la Audiencia Provincial de Barcelona, se analiza la figura del Arbitrador, se diferencia su papel del correspondiente al Árbitro y se compara con la figura del «Experto» recogida en el Proyecto de Ley de Medidas de Eficiencia Procesal del Servicio Público de Justicia de 22 de abril de 2022, así como con la práctica internacional de la Expert Determination (Experto Determinante), analizando sus características y valorando la oportunidad que brinda la soft law creada en torno a esta figura para definir con unos límites más precisos la función del Experto y proteger el ejercicio de la misma.
Taking a Sentence issued by the Court of Hearings of Barcelona as starting point, the Author analyzes the spanish traditional figure of the «Arbitrator» (a kind of independent umpire requested by the parties in order to determine the price in a sale agreement or the earnings liquidation of a civil society), comparing it with the figure of the «Expert» contemplated in a future law, still under the aprobation process, to be issued in order to improve the functioning of the Justice Courts, as well as with the international state of the art of «Expert Determination» as an ADR. The article refers to the characters of said Expert Determination figure and praises positively the oportunity that the «soft law» which protects the figure will permit a more precise development of the Expert´s functions and a higher assurance on its outcome.
