    Los civilistas partimos de un axioma que a menudo les cuesta aceptar a nuestros clientes: en un proceso judicial no importa tanto la verdad material como lo que finalmente puedas demostrar. Ciertamente y en virtud del principio de justicia rogada, los tribunales deben atenerse en sus resoluciones a los hechos alegados por las partes, a la prueba suministrada por ellas y a las pretensiones que oportunamente hubieran deducido en el proceso. De ahí que sea fundamental preguntarnos no sólo qué tipo de prueba debemos proponer sino también qué umbral o nivel de convencimiento deber tener el juez para considerar acreditados los hechos. Los estándares de prueba establecen criterios de suficiencia que permiten aventurar si ese hecho en el que se fundamenta nuestra pretensión se considerará probado o no por el órgano judicial.

    The starting point for civil lawyers is an axiom that their clients often find hard to accept: in a judicial process, the material truth is not as important as what can finally be proven. Certainly, and by virtue of the principle of party disposition, the courts must abide in their rulings to the facts set out by the parties, to the proof they provide and to the claims duly disposed of in the proceedings. On that basis, it is essential to ask not only what type of proof should be proposed but also what threshold or level of conviction should the judge have to consider the facts proven. Standards of proof establish levels of sufficiency that allow claimants to discern whether or not the fact on which their claim is based will be considered proven by the judicial body.
