    El objetivo de este artículo fue analizar el rol que ejerce el Estado como garante de los derechos humanos de las personas privadas de su libertad y la responsabilidad internacional que acarrea la falta de protección dentro de los centros de rehabilitación social bajo su cargo. La relevancia del estudio se centra en precisar cuáles son las obligaciones del Estado con este grupo vulnerable para un efectivo ejercicio de sus derechos. Se aplicó una metodología documental-bibliográfica, así como una encuesta que permitió demostrar la obligación que tiene el Estado de prevenir hechos que atenten contra la vida e integridad de los privados de libertad en las cárceles ecuatorianas. Los resultados dan cuenta que, a pesar de ocurrir un sinnúmero de hechos lamentables dentro de los centros de privación de libertad en el año 2021, el Estado ecuatoriano no ha ejecutado medidas conducentes a frenar esta ola de violencia. Se concluye que, todos los hechos acaecidos dentro de los centros de privación de libertad han podido prevenirse y evitarse a través de un mayor control estatal, empero las autoridades respectivas oportunamente no lo hicieron, resultando inevitable que el Ecuador sea declarado responsable por la Corte Interamericana de Derechos Humanos por la violación a estos derechos.

    The objective of this article was to analyze the role that the State exercises as guarantor of the human rights of people deprived of their liberty and the international responsibility that the lack of protection in social rehabilitation centers entails. The relevance of the study focuses on specifying what the obligations of the State are with this vulnerable group for an effective exercise of their rights. A documentary-bibliographical methodology was applied, as well as a survey that allowed demonstrating the obligation of the State to prevent events that threaten the life and integrity of those deprived of liberty in Ecuadorian prisons. The results show that, despite the occurrence of countless unfortunate events within the deprivation of liberty centers in 2021, the Ecuadorian State has not implemented measures to stop this wave of violence. It is concluded that all the events that occurred within the deprivation of liberty centers have been prevented and avoided through greater state control, however, the respective authorities did not do so in a timely manner, resulting inevitably that Ecuador be declared responsible by the Inter-American Court. of Human Rights for the violation of these rights.
