    Este trabajo analiza el deber del Estado parte en la Convención Americana sobre Derechos Humanos de adoptar medidas legislativas o de otro carácter para cumplir con las obligaciones de respeto y garantía de los derechos y las libertades reconocidas en ella y el rol que juega el control de convencionalidad para asegurar su disfrute y goce. Resalta la importancia del Poder Legislativo en la promoción, respeto y garantía de los derechos humanos y la necesidad de adoptar, en el proceso de formación de las leyes, las medidas pertinentes, incluyendo el control de convencionalidad, para evitar la vulneración de los derechos humanos y la consiguiente responsabilidad internacional del Estado por la presencia de normas jurídicas contrarias a la Convención Americana en su derecho interno. Asimismo, hace referencia al ejercicio del control de convencionalidad por parte de la Convención Constitucional Chilena.

    This work analyzes the duty of the State party to the American Convention on Human Rights to adopt legislative or other measures to comply with the obligations of respect and guarantee of the rights and freedoms recognized in it and the role played by the control of conventionality to ensure your enjoyment and enjoyment. Emphasizes the importance of the Legislative Power in the promotion, respect and guarantee of human rights and the need to adopt, in the process of forming laws, the pertinent measures, including the control of conventionality, to avoid the violation of human rights and the consequent international responsibility of the State for the presence of legal norms contrary to the American Convention in its domestic law. Likewise, it refers to the exercise of conventionality control by the Chilean Constitutional Convention.
