    En el presente trabajo se analizan los dilemas éticos y jurídicos que se presentan en torno a una de las técnicas de fertilización asistida comúnmente llamada “gestación por subrogación de vientres”. La controversia que genera esta práctica está dada no sólo por la cosificación de la mujer y del niño por nacer y por la afectación de ciertos derechos humanos implicados, como la dignidad de la persona, la identidad, la no discriminación, sino además porque atraviesa una de las fibras más íntimas de todo ser humano.

    In the present work, the ethical and legal dilemmas that arise around one of the assisted fertilization techniques commonly called “gestation by surrogacy of wombs” are analyzed. The controversy generated by this practice is given not only by the objectification of women and unborn children and by the affectation of certain human rights involved, such as the dignity of the person, identity, non-discrimination, but also because it goes through a of the most intimate fibers of every human being. Currently there is a legal vacuum in our country regarding the regulation of this practice. Consequently, the interpretation of current regulations for the correct treatment of the subject is especially relevant.
