La inteligencia artificial, ¿un nuevo agente responsable?

    Con la evolución tecnológica se proyecta un nuevo futuro en la justicia., pero los sistemas de inteligencia artificial que se utilizan en la investigación y el proceso judicial estadounidense aún no se vislumbran en nuestro panorama nacional. Sin embargo, más allá de la inteligencia artificial, la robótica muestra un futuro muy cercano lleno de incertidumbres en la que los robots podrán ser responsables, incluso penalmente. En este articulo se examina el paradigma de los robots como posibles sujetos activos y pasivos del delito desde la necesaria exigencia del elemento volitivo y el elemento objetivo de delito y la necesidad de regular el futuro.

    With the technological evolution, a new future in justice is projected, but the artificial intelligence systems that are used in the investigation and the American judicial process are not yet glimpsed in our national panorama. However, beyond artificial intelligence, robotics shows a very near future full of uncertainties in which robots may be held responsible, even criminally. In this article, the paradigm of robots as possible active and passive subjects of crime is examined from the need of the volitional element and the objective element of crime and the need to regulate the future.
