La teorización por parte de WARREN y BRANDEIS del derecho a la intimidad (en general, la vida privada, en términos preferibles al anglicismo “privacidad”) ya consagraba en el siglo XIX “«el derecho del individuo a ser dejado solo»”. En esencia, nos referimos al derecho a decidir qué conocimiento tiene la sociedad de aspectos personales tan íntimos como son las propias acciones privadas, los gustos y los hábitos. Dicho de otro modo, todo aquello que se desarrolla en la esfera privada más íntima de las personas. En este marco conceptual podemos englobar las conversaciones que mantenemos de manera privada con otras personas, aquellas respecto de las que cabe reconocer una protección que desborda la dimensión más individual y subjetiva, presentado además una dimensión colectiva y social que permite definir los lindes del sistema democrático. En este contexto se analizará, de forma coetánea al estudio jurisprudencial de la cuestión, si la grabación, realizada sin conocimiento por parte de uno de los intervinientes en la conversación, y la posterior difusión de estas conversaciones, afecta o no al derecho a la vida privada o a la intimidad personal, abordando los derechos e intereses en juego en esta dualidad de equilibrios.
The WARREN and BRANDEIS theorizing of the right to privacy (in general, private life) already enshrined in the XIX century “«the right to be let alone»”. We are referring essentially to the right to decide what knowledge society has of personal aspects as intimate as their own private actions, tastes and habits. In other words, everything that takes place in the most intimate private sphere of people. In this framework we can include the conversations that we have privately with other people, those with respect to which it is possible to recognize a protection that goes beyond the most individual and subjective dimension, also presenting a collective and social dimension that allows us to define the boundaries of the democratic system. In this context, it will be analysed, at the same time as the jurisprudential study of the issue, whether the recording, made without the knowledge of one of the participants in the conversation, and the subsequent dissemination of these conversations, affects or not the right to privacy or personal intimacy, addressing the rights and interests at stake in this duality of balances.
