El objetivo de este artículo es mostrar tres problemas que afectan la claridad del lenguaje de las sentencias judiciales en dos áreas: una medida de protección y la falta de servicio. El primero es la ausencia de una estructura fija de razonamiento que ordene la fundamentación de la decisión. El segundo es la ausencia de una función asignada a los considerandos que forman la sentencia. El tercero es la ausencia de explicitación de las técnicas de interpretación e integración del derecho que se usan por el juzgador. Para cada uno de estos problemas se propone una solución.
The objective of this article is to show three problems that affect the clarity of the language of judicial decisions in two areas: measure protection and the lack of service. The first is the absence of a fixed structure of reasoning that orders the foundation of the decision. The second is the absence of a function assigned to the recitals that make up the sentence. The third is the absence of explanation of the techniques of interpretation and integration of the law that are used by the judge. For each of these problems, a solution is proposed.
