Resumen de La suma de posesiones en Colombia. Nexo jurídico jurisprudencial hacia un estándar de prueba en el proceso de pertenencia

  En el presente artículo se realiza un análisis de la suma de posesiones en la ley sustancial, exponiendo las diferentes posturas que la Corte Suprema de Justicia sobre el tema,  desarrollando las tipologías consagradas en el Código Civil Colombiano y la forma de probarse la suma de posesiones en cada una de ellas. Finalmente se desarrolla una propuesta de los medios probatorios de la suma de posesiones cómo un estándar de prueba que debería manejarse y agregarse cómo una norma procedimental en el código General del Proceso, a partir del desarrollo de la hipótesis de la existencia de un estándar de la prueba en el proceso de pertenencia.  Este trabajo se desarrolló desde la línea de investigación: Desarrollo Humano, Jurídico y Social con un enfoque cualitativo, descriptivo y hermenéutico.

  In this article an analysis of the sum of possessions in the substantial law is carried out, in the same way the different positions of the Supreme Court of Justice on the subject are exposed and the typologies enshrined in the Colombian Civil Code and the form of the how the sum of possessions should be proven in each one of them and finally a proposal of the means of proof of the sum of possessions is developed as a standard of proof that should be handled and added as a procedural norm in the General Process code. This work was developed from the research line: Human, Legal and Social Development with a qualitative, descriptive and hermeneutical approach that develops the hypothesis of the existence of a standard of proof in the process of belonging.
