Tensiones jurídicas y políticas en torno a la eutanasia en Colombia

    En el artículo se exploran las tensiones políticas y jurídicas de la articulación institucional de las ramas judicial, legislativa y ejecutiva en la regulación del homicidio pietístico en Colombia. Se muestra cómo ha sido la Corte Constitucional la que se ha empeñado en que la materia se regule desde 1997. Asimismo, se analiza cómo desde entonces no ha habido una colaboración armónica de parte del Congreso, debido a los fracasos de las iniciativas legislativas para regular la materia, en parte por las fuertes disputas ideológicas y discusiones éticas al interior de esa institución. Se aborda también el rol del Ministerio de Salud y Protección Social, que, ante la inactividad del Congreso y por presión de la Corte, adoptó algunos parámetros para regular la eutanasia en el país. Por último, se concluye que tras las pugnas normativas existen luchas políticas, pues son estas, como señaló Bobbio, “dos caras de una misma moneda”.

    The article explores the political and legal tensions of the institutional articulation of the judicial, legislative and executive branches in the regulation of pious homicide in Colombia. It shows how it has been the Constitutional Court who has insisted that the matter should be regulated since 1997. It also analyzes how, since then, there has been no harmonious collaboration from the Congress, due to the failure of legislative initiatives to regulate the matter, partly because of strong ideological disputes and ethical discussions within that institution. It also discusses the role of the Ministry of Health and Social Protection, which, in the face of congressional inactivity and under pressure from the Court, adopted some parameters to regulate euthanasia in the country. Finally, it is concluded that behind the normative struggles there are political struggles, since these are, as Bobbio pointed out, "two sides of the same coin".
