Resumen de El territorio: derecho fundamental de las comunidades afrodescendientes en Colombia
A partir de la Constitución de 1991 se generó una situación de reconocimiento de derechos especiales a las comunidades negras que ocupan y habitan territorios colectivos, y que han vivido de acuerdo con sus costumbres y tradiciones. Este trabajo sustenta la fundamentalidad del derecho al territorio de estos grupos étnicos, reconoce las dimensiones de este derecho y observa el estado de su garantía en Colombia. Además, introduce categorías de análisis para comprender la naturaleza de este derecho, con el propósito de generar debates alrededor de su garantía, ejercicio y exigibilidad.Palabras Clave : Comunidades afrodescendientes, Constitución de 1991, Derechos, Territorio, Legislación, Cultura ABSTRACTHE TERRITORY: A FUNDAMENTAL RIGHT OF THE AFRODESCENDANT COMMUNITIES IN COLOMBIA Th e Constitution of 1991 recognizes special rights to the black communities that occupies and inhabits collective territories, and that have lived according to their customs and traditions. Th is work sustains the stand of fundamental of the right of the territory of these racial groups, recognizes the dimensions of this right and observes the state of it fulfi lment in Colombia.
