    The decentralized technology of blockchain is analyzed to conclude that the balance between confidence, freedom and equality by this type of tool is not parallel ed in the real world, so that the viable and effective regulation of the phenomenon is the one that starts from transnational source, since the appli­cation operates solutions that were never made feasible by the structures of the Nation-State. The methodology is hypothetical-deductive in order to assess the feasibility of the hypothesis based on the national and foreign literature, especially the scientific production of the SSRN database and the comparison of national and international regulations (comparative law).

    Analisa-se a tecnologia descentralizada da cadeia de blocos para concluir que o equilíbrio propiciado entre confiança, liberdade e igualdade por esse tipo de ferramenta não encontra paralelo no mundo real, de modo que a regulamen­tação viável e eficaz para o fenômeno é a que parta de fonte transnacional, eis que o aplicativo opera soluções que nunca foram viabilizadas pelas estruturas do Estado-Nação. A metodologia é a hipotético-dedutiva para se aferir a via­bilidade da hipótese com base na literatura nacional e estrangeira, sobretudo a produção científica da base de dados SSRN e cotejo de regulações nacionais e internacionais (Direito Comparado).
