La instrucción Crimen sollicitationis (1922): La competencia del Santo Oficio en delitos de naturaleza sexual cometidos por clérigos

    A principios del siglo XX, las autoridades del Santo Oficio constataron un preocupante aumento del número de denuncias y procesos por el delito de solicitación. Esta situación y la necesidad de actualizar las normas reguladoras de la materia contenidas en la Constitución Sacramentum Poenitentiæ de 1741 constituyeron el punto de partida de un itinerario que, reconociendo sus raíces en el siglo XIX, desembocó en 1922 en la Instrucción Crimen sollicitationis. Esta normativa contemplaba los delitos de naturaleza sexual sujetos a la competencia del Santo Oficio. El objetivo de este artículo es presentar esta Instrucción que, destinada a los Ordinarios locales, regulaba detalladamente el procedimiento para el tratamiento de un delito que en aquel momento afligía gravemente a la Iglesia y que, contemplando otros crímenes, incluía por primera vez en la competencia del Santo Oficio los delitos sexuales cometidos por clérigos sobre impúberes.

    At the beginning of the 20th century, the authorities of the Holy Office noticed a worrying increase in the number of complaints and prosecutions for the crime of solicitation. This situation and the need to update the regulatory norms relating to the matter contained in the 1741 Constitution - Sacramentum Poenitentiæ marked the start of the process that, stemming from its origins in the 19th century, led to the 1922 Instruction Crimen sollicitationis. These stipulations would regulate crimes of a sexual nature subject to the competence of the Holy Office. The purpose of this article is to present this Instruction which, addressed to local Ordinaries, regulated in detail the process for addressing a crime that at the time seriously afflicted the Church and, while contemplating other delicts, included for the first time within the competence of the Holy Office sexual crimes committed by clerics against prepubescent children.
