The Joint Sections of the Supreme Court settle the debated issue concerning the applicability of the art. 131-bis c.p. to the continued crime, deciding in the sense of the compatibility between the two legal institutes. After having examined the different points of view on the matter, the article analyzes the key arguments of the judgment, which led the Supreme Court to adopt a decision which is coherent with the provisions of law, the aim of the involved institutes and logical-systematic reasons. The Author also points out the most innovative topics emerging from the ruling of the Court.

Le sezioni unite intervengono a definire la vexata quaestio relativa all’applicabilità dell’art. 131-bis c.p. al reato continuato, esprimendosi in senso favorevole alla compatibilità fra i due istituti. Dopo aver esaminato gli orientamenti che si sono confrontati sul tema, il contributo analizza le argomentazioni chiave della pronuncia, che hanno portato il Massimo Consesso ad adottare una soluzione che risulta coerente con la lettera della legge, con le finalità degli istituti coinvolti e con motivazioni di ordine logico-sistematico ad essi sottese. Si sottolineano, infine, gli aspetti più innovativi che emergono dalla decisione in esame.
