    Las televisiones públicas y privadas en España han transmitido, desde su nacimiento, bajo el principio de universalidad que rige a todos los medios audiovisuales en España. No obstante, a raíz del Primer Dividendo Digital (finalizado en diciembre de 2014) y el Segundo Dividendo Digital (finalizado en diciembre de 2020), su continuidad como medio de acceso público y universal se ve en serio peligro al reducirse los anchos de bandas en estas nuevas frecuencias. De acuerdo con el nuevo reordenamiento del espectro radioeléctrico, las televisiones en abierto deberán operar en las bandas de frecuencia inferiores a los 700 MHz; es decir, la banda que va de los 470-694 MHz. Con este cambio, se reducen también las posibilidades de implementar nuevos servicios y características de la evolución de la televisión digital (como las tecnologías UHD, la televisión interactiva, nuevos servicios en línea, etcétera).

      Según se resuelva este conflicto de intereses, el derecho al acceso a una información, un entretenimiento y una culturización en abierto, gratuita (al menos directamente) y con estándares profesionales de calidad puede quedar vacío de contenido y de realidad en muy poco tiempo.

    The structure of the article is divided into two parts: the first one starts with an introduction to the principle of universality of public service and its implementation in Spain, and here we also refer to the recent situation of the public broadcaster, Televisión Española (TVE), when it comes to funding and audience. In the second part we analyze the two digital dividends that have taken place in Spain, including the auction for band spectrum of July 2021, and we also study the confronting positions of the ‘open’ audiovisual sector stakeholders and companies and the Spanish government.

      Among the objectives that we pretend with this article are to alert about the looming uncertainty for open access televisions – either public or private – and their principles of universality and free access. This is due to the legislation that right now is applied to implement the 5G technology in Spain. In the conclusions these questions are answered, even though this is an important issue in continuous evolution, and we look forward to follow-up and be able to update these conclusions in the future.
