    El derecho de la discapacidad suscita desde hace tiempo un notable interés. Este estudio tiene por objeto abordar el papel de la discapacidad en la formación de la jurisdicción voluntaria en España, abordando específicamente el rol tuitivo que el Juez —o en su caso el Alcalde—ejercía respecto de las personas con discapacidad, desde el Derecho Romano hasta las primeras reformas tras la Constitución de 1978.

    Disability law has long been of considerable interest. This studyaims to address the role of disability in the formation of voluntary jurisdiction in Spain, specifically addressing the protective role that the judge —or the mayor, as the case may be—exercised with respect to persons with disabilities, from Roman Law until the first reforms after the Constitution of 1978.
