Il diritto di odiare. Spunti su responsabilità e performativo

    Among the many arguments put forward to limit or forbid hate speech, there is one in particular, which is derived from a particular theory of language. It is argued that the language of hatred is a performative, that is, a sentence that is also an action, as it involves modifying effects of reality, determining subordination and discrimination in the recipient, or inducing others to hate certain categories of people. As an action, therefore, the language of hatred is removed from the protection that the law guarantees to the word, which instead is free. This argument is unfounded. The fact that the language of hatred towards others is a performative does not imply that it is to be judged legally in an unfavorable way. The legal prohibition of hate speech cannot be drawn from a theory of language. These brief reflections aim to demonstrate this.

    Tra i tanti argomenti che si adducono per limitare o vietare di discorsi di odio, ve ne è uno in particolare, che viene ricavato da una particolare teoria del linguaggio. Si sostiene che il linguaggio di odio è un performativo, ossia un enunciato che è anche una azione, in quanto comporta effetti modificativi della realtà, determinando subordinazione discriminazione nel destinatario, oppure inducendo altri ad odiare determinate categorie di persone. In quanto azione, dunque, il linguaggio di odio è sottratto alla tutela che la legge assicura alla parola, che invece è libera. Questa argomentazione è infondata. Il fatto che il linguaggio di odio verso gli altri sia un performativo non implica che sia da valutare giuridicamente in modo sfavorevole. Non si può trarre il divieto giuridico del discorso di odio da una teoria del linguaggio. Queste brevi riflessioni mirano a dimostrarlo.
