    Todo proceso jurisdiccional requiere necesariamente la existencia de dos posiciones enfrentadas, conformadas cada una de ella por dos o más sujetos jurídicos cuya exacta identificación corresponde a quien reclama. Sin embargo en el orden civil, dicho proceso no tiene por qué desarrollarse únicamente entre quienes señale el demandante, pues no solo está en juego la victoria de los litigantes, sino también la justicia y la salvaguarda del ordenamiento jurídico.

    Conscientes de ello, en el presente trabajo reflexionamos sobre los sujetos jurídicos que pueden solicitar la anulación de un laudo arbitral y si un tercero puede ser autorizado para participar en el proceso declarativo especial para defender sus propios intereses, asumiendo que tal autorización normalmente la pedirá en su caso alguno de los que fueron parte en el procedimiento arbitral en que se dictó el laudo.

    Como es lógico, la respuesta dependerá de lo que disponga la legislación aplicable, pero también de la doctrina fijada por nuestros tribunales al interpretar dicha legislación, tarea a la que dedicamos especial atención por tratarse de una cuestión poco analizada hasta ahora en los estudios que se han ocupado de esta materia.

    Every jurisdictional process necessarily requires the existence of two opposing positions, each one consisting of two or more legal subjects whose exact identification corresponds to the plaintiff. However, in case of a civil process, it does not have to be developed only between those subjects indicated by the plaintiff since the result not only concerns the victory of the litigants but also justice and the safeguarding of the legal system.

    In this work, a reflection on what are the legal subjects that can request the nullity of an arbitral decision and whether a third party can be authorized to participate in the special declaratory process to defend their own interests is presented, assuming that the authorization will normally be requested by any of the parties involved in the arbitration procedure in which the judgment was issued.

    As it is logical, the answer will depend on the applicable legislation but also on the doctrine established by our courts when interpreting the legislation, a task to which we dedicate special attention because it is an issue little analysed until now in the current studies on this matter.
