    El presente trabajo tiene por objeto el examen de los deberes legales a que se ve sometido el testigo en el proceso penal. En particular, tras un breve acercamiento a esta figura, se analiza la regulación contenida en la LECrim tras su reforma de 2021 —sugerida previamente por el Anteproyecto de LECrim de 2020— y la interpretación realizada por la jurisprudencia de los supuestos de excepción a estas obligaciones: las dispensas del deber de declarar y las exenciones a la obligación de acudir al llamamiento judicial. Igualmente, el estudio se ocupa de la respuesta ofrecida por el legislador y los tribunales a la desviación de la norma, prestando una especial atención a los apercibimientos y advertencias al testigo de las posibles sanciones, así como al incumplimiento de su deber de ser veraz, el delito de falso testimonio y los contornos legales de la figura de la retractación.

    The purpose of this work is to examine the legal duties to which the witness is subject to in criminal proceedings. In particular, after a brief approach to this figure, it analyzes the regulation contained in the LECrim after its reform of 2021 —suggested previously by the Preliminary Draft of the LECrim of 2020— and the interpretation made by the jurisprudence of the exceptions to these obligations: the exemptions from the duty to testify and the exemptions to the obligation to attend to court. Likewise, the study deals with the response offered by the legislator and the courts to the deviation of the rule, paying special attention to the different warnings to the witness regarding possible sanctions, as well as the breach of his duty to be truthful, false testimony crime and the legal contours of the figure of recantation.
