    En 2019, en el marco de los trabajos para la reforma de la Convención sobre Ciertas Armas Convencionales, España presentó su Posición Respecto al Papel de la Ciencia y la Tecnología en el Contexto de la Seguridad Internacional y el Desarme. Nuestro país se comprometió a realizar un análisis jurídico previo a la adquisición o fabricación de sistemas de armas autónomas (SAA) para comprobar su compatibilidad con el Derecho Internacional Humanitario (DIH) y garantizar la responsabilidad por un posible mal uso. En este artículo se analizan los problemas jurídico-penales que pueden plantearse en la utilización de este tipo de armas y se hacen recomendaciones sobre el contenido que debería tener el preceptivo examen jurídico previo.

    In 2019, in the framework of the work for the reform of the Convention on Certain Conventional Weapons, Spain presented its Position on the Role of Science and Technology in the Context of International Security and Disarmament. Our country undertook to carry out a legal analysis prior to the acquisition or manufacture of autonomous weapons systems (AWS) to check their compatibility with IHL and ensure responsibility for possible misuse. This article analyzes the legal-criminal problems that may arise in the use of this type of weapons and makes recommendations on the content that the mandatory prior legal review should have.
