La circunstancia agravante de alevosía doméstica: su aplicación jurisprudencial a las mujeres mayores víctimas mortales de la violencia de género.

    La vulnerabilidad de la mujer es consustancial a la propia estructura social fundada sobre las bases del dominio patriarcal. Ello explica por qué la violencia de género afecta de forma transversal a todas las mujeres con independencia de su clase social, etnia, religión, nacionalidad o edad. Respecto a este último factor, la especial vulnerabilidad que presentan las mujeres mayores de 65 años víctimas de violencia de género ha llevado a que en el Pacto de Estado se incluya, como una de las medidas a implementar, la realización de estudios que incidan sobre su situación. Los datos muestran que el 8,89% de las mujeres víctimas mortales de la violencia de género entre los años 2003 a 2021 tenían más de 61 años. En los años 2004, 2012 y 2020, este fue el segundo grupo de edad en que se registró un mayor número víctimas mortales. El presente trabajo tiene por objeto analizar el tratamiento jurídico penal de estas muertes y, más concretamente, la aplicación de la circunstancia agravante de alevosía. A tal efecto, se establecen pautas para una configuración de la alevosía doméstica con perspectiva de género.

    Women's vulnerability is inherent to the very social structure founded on the basis of patriarchal dominance. This explains why gender-based violence affects all women across the board, regardless of their social class, ethnicity, religion, nationality or age. With regard to this last factor, the special vulnerability of women over 65 who are victims of gender violence has led the Pact of State to include, as one of the measures to be implemented, the carrying out of studies that have an impact on their situation. The data show that 8.89% of the women who died as victims of gender violence between 2003 and 2021 were over 61 years of age. In the years 2004, 2012 and 2020, this was the second age group with the second highest number of fatalities. The aim of this paper is to analyse the criminal legal treatment of these deaths and, more specifically, the application of the aggravating circumstance of malice aforethought. To this end, guidelines are established for a configuration of domestic aggravation with a gender perspective.
