La ley penal española incrementa el castigo del delito cuando el autor ha actuado por motivos discriminatorios. Se atiende en este trabajo a qué significa ‘motivos discriminatorios’ (y a si es lo mismo requerir esto que atender a ‘razones basadas en algún tipo de discriminación’) y cómo debe probarse esta motivación, teniendo en cuenta los principios informadores del Derecho penal y la tensión entre principios constitucionales inherente a esta problemática.

Spanish criminal law increases punishment of offences whenever the author had a discriminatory motivation. This paper looks at what ‘discriminatory motives’ means (wondering whether ‘reasons based on some sort of discrimination’ has the same meaning) and how this motivation should be proven, considering general principles of criminal law and the tension between constitutional principles inherent to this problem.
