Banking foundations are private entities which foster non-profit entities in the Third Sector but are not regulated by the Third Sector Code. They organize social freedoms and are set in-between public institutionand the community of citizens. The legal limits to the activities of banking foundations have led to a typical mode of ‘indirect’ action, through calls for proposals that activate a community. Article 42 of the ItalianConstitution, which outlines the social function of private property, can also shed light over this peculiar mode of action of banking foundations.
Le fondazioni bancarie sono enti di diritto singolare, di natura privatistica, che svolgono un’attività di promozione del terzo settore senza essere regolate dal Codice del terzo settore. I limiti legali allosvolgimento dell’attività delle fondazioni bancarie hanno determinato una modalità tipica di azione “indiretta”, per il tramite di bandi che attivano una comunità. Questa peculiare modalità di azione puòessere inquadrata nella riflessione più moderna sull’art. 42 Cost. e la funzione sociale della proprietà privata.
