Tras el aluvión de demandas de pensionistas varones reclamando el complemento por maternidad, resueltas en cientos de Sentencias con criterios divergentes en cuanto a la fecha de los efectos de reconocimiento, por fin el TS sienta su criterio. De las dos alternativas que han llegado a la Sala, el TS opta por una tercera, considerando que deben extenderse ex tunc, al nacimiento mismo de la norma y consecuente acaecimiento del hecho causante.

After the flood of lawsuits from male beneficiaries claiming maternity allowance, resolved in hundreds of rulings with diverging criteria as to the date of the effects of recognition, the SC has finally established its criteria. Of the two alternatives that have reached the Court, the SC opts for a third, considering that they must be extended from the outset, to the actual birth of the rule and consequent occurrence of the causal event
